O Projeto de Lei 296/19 pretende obrigar a União e os estados a implementar compensações financeiras aos municípios que abrigam unidades prisionais, devido aos impactos decorrentes dessas instalações. Os recursos serão oriundos do Fundo Penitenciário Nacional (Funpen).
A proposta está em análise na Câmara dos Deputados. Trata-se da reapresentação, pelo deputado Rubens Otoni (PT-GO), de proposta aprovada em 2018 pela Comissão de Desenvolvimento Urbano (PL 7757/17) e arquivada ao final da legislatura passada, como determina o Regimento Interno.
O texto insere dispositivos no Estatuto das Cidades (Lei 10.257/01) e na Lei Complementar 79/94, que criou o Funpen. A compensação não poderá ser inferior a 1% do custo de implantação da unidade prisional, e os municípios deverão receber anualmente 0,5% da despesa de manutenção.
Entre outras finalidades, o dinheiro do Funpen deverá ser utilizado para ampliação da oferta de serviços públicos – especialmente saúde, educação e segurança pública – e em medidas que diminuam os problemas apontados por estudos de impacto ambiental e de impacto de vizinhança.
Tramitação
A proposta tramita em caráter conclusivo e será analisada pelas comissões de Desenvolvimento Urbano; de Segurança Pública e Combate ao Crime Organizado; de Finanças e Tributação; e de Constituição e Justiça e de Cidadania.
